 Credit Repair Service Agreement for

 

hereafter known as "Client", located at , , hereby enters into the following agreement with Ncredible Credit Repair LLC, hereafter known as “Company”.

Scope of Service(s)

Company shall provide the Services and Deliverable(s) as follows:

  • Assist Client with improving their FICO/credit scores and credit history
  • Provide consulting services on credit history and work hard to improve Client credit rating and clear and/or correct your credit report of the credit and personal items which Client believes and identifies to be inaccurate, misleading or unverifiable.

Payment

Client agrees the following in exchange for credit repair and education:

  1. $149.00 Audit Fee & First Month’s Payment for ‘Premium Package with Credit Report’ ($149.00) due immediately after agreement has been signed and finalized.
    • Any Deposits made will be applied to Sign Up Fee and/or First Month’s payment
  2. Monthly payment will be charged and processed every thirty (30) days thereafter.
  3. Client authorizes the scheduled charge to their checking/savings account or debit/credit card. Client will be charged the amount indicated above and understand, acknowledge and agree that in the event they elect to pay by ACH draft or Credit/Debit Card. Lastly, Client agrees that no prior notification will be provided unless the date or amount changes, in which case they will receive notice from Company at least 10 days prior to the payment being collected.
  4. Client agrees to pay Company an additional service charge of $25 for all dishonored payments.

 Terms and Conditions

  1. Client agrees to retain Company to provide any of the services listed in the Scope of Services, including but not limited to, disputing negative items on your credit you believe may be inaccurate, misleading, or
  2. Client understands and acknowledges that failure to timely pay for whatever reason will suspend all work on Client’s behalf, including but not limited to, stopping all correspondence with the credit bureaus or creditors and any consulting services to be performed on Client behalf, until payment in full is received. After thirty (30) days of any failure to make a timely payment, Company will close Client account and cease any communications with Client. To use Company services after failure to make a timely payment within thirty (30) days, Client agrees and acknowledge that Client may be required to establish a new account and pay all applicable “first-work/audit/registration” fees again.
  3. Client agrees to forward copies of all correspondences they receive from any credit bureau, including but not limited to letters and credit reports, and promptly inform Company of any changes in their physical address and/or email address. Client understands that Company cannot perform the service provided without obtaining copies of the credit reports and all correspondence from the credit
  4. Client acknowledges and agrees that they request that Company dispute all inaccurate, unverifiable, and/or derogatory information found on their credit reports except for information disclosed separately.
  5. Client understands and acknowledges that their failure to comply with any of these Terms and Conditions may prevent Company from performing the requested services, may delay the performance of any services on their behalf and may void any and all of the guarantees contained herein at Company sole
  6. Client agrees that any correspondence sent on their behalf and/or in their name by Company are proprietary to Company and will not be made available to Client. In event the Client requests proof of work, they may submit their request in writing to Company. Company has 10 business days to respond to the Client’s In the event the request for proof of work is accepted, Client agrees and understands that all information other than the account information, personal information and date sent will be redacted.
  7. Client agrees to make copies of any documents provided to Company to retain with their personal records. Client acknowledges that Company may not return documents forwarded to them and is under no obligation to retain copies of the correspondence sent to the credit bureaus on your behalf.
  8. Client understands that it is Company policy to shred all documents not required to be retained by law after thirty (30) days of completion of the services provided or upon cancellation of Company services, whichever occurs
  9. Client acknowledges and agrees that Company will not discuss their case with any unauthorized person (including Client spouse/family member/significant other, etc.) unless Client provides prior written authorization to Company.
  10. Client agrees that everything that Client has stated to Company is true and correct to the best of their knowledge.
  11. Client acknowledges their receipt of a copy of this agreement and the disclosures required by the Credit Repair Organizations Act (CROA, Sec. 405).

Particular issues involved in each individual case may vary from case to case, Company cannot guarantee a specific outcome or accurately predict how long the process will take. The average time for most Clients is two (2) to six (6) months. As such, the dispute process, or credit cards or debt negotiations may take more or less than nine (9) to twelve (12) months.

Company relies on the accuracy and truthfulness of the information that “you” provide to perform their services.

Company disclaims any guarantee herein contained if Client does any of the following:

  • Provides inaccurate information of any kind, included but not limited to, any personal information
  • Changes their mailing address without notifying Company ten (10) days prior to change of address
  • Adds any new negative accounts to their credit report(s)
  • Obtains new credit not previously authorized by Company
  • Exceeds 30% of the credit limit on any open credit account
  • Violates or fails to fully comply with any of the Terms and Conditions contained herein
  • Hires another credit repair Company to repair their credit or attempts to repair their own credit whilst part of the Company program

Credit Monitoring

The Client elects to enroll in Company’s in-house 3-bureau Credit Reporting Service for the duration of service with Company. Client acknowledges that failure to maintain a 3-Bureau Credit Report Service active constitutes potential forfeiture of their Credit Repair Services.

Credit Repair Service Authorization

  1. The Client hereby authorizes Company to write, send, receive, sign, and perform all actions on my behalf as necessary to update information in my credit reports. Instruments of any nature shall be used as necessary in the exercise of the rights and powers herein
  2. This authorization may be revoked by the Client by giving 3-day written notice to Company.
  3. I hereby release and hold harmless Company and its employees, agents, contractors, principals, interested parties from any and all matters of actions, causes of action, suits, proceedings, claims, damages, and demands whatsoever in law or equity, for or by any reason or cause regarding this

Consumer Credit File Rights Under State and Federal Law

 “You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor a credit repair Company or credit repair organization has the right to have accurate, current and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported up to 10 years.

You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

You have a right to sue a credit repair organization that violated the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations.

You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.

Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur.

You may, on your own, notify a credit bureau in writing that you dispute that accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.

If the credit bureau's reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.

Your Right to Cancel

Cancellation

“You may cancel this contract, without any penalty or obligation, at any time before midnight of the 3rd day which begins after the date the contract is signed by you. To cancel this contract, mail, or email a signed and dated cancellation notice to:

before midnight on the 3rd day which begins after the date you have signed this contract stating "I hereby cancel this Credit Repair Service Agreement, Signed (Client Signature) (Date of Signature)"

 I hereby acknowledge the receipt of my Right to Cancel. I have read and understand the terms of this agreement, and I acknowledge that I have received a copy of my Consumer Credit File Rights. By signing this Agreement, I also acknowledge and agree that I have read and agree to all of the terms of this Agreement. If I chose not to agree to any of the terms herein, I understand that Company will not be able to represent me, nor will I be a Client of Company.
